Deciding Tax Cases in an International Court
In today’s rapidly changing era of taxation post-BEPS, this panel addresses the judicial approach to deciding tax cases in an international context. It will commence with an expert presentation from Dr Péter Darák, President of the Curia, the supreme judicial authority of Hungary, on deciding tax cases in the international and European tax context, in a civil law jurisdiction. A panel of experts will provide comments from an Australian perspective including on recent cases, and the Chair will facilitate a panel discussion and questions from the floor. Topics include different approaches to statutory and tax treaty interpretation in the new international tax era; tax incentives and state aid in Europe; and interpretation of specific and general anti-abuse rules.
This event will be held in the Federal Court in Melbourne and can be viewed by Livestream in other states.

President Dr Péter Darák is President of the Curia of Hungary, the supreme judicial authority of Hungary. Dr Darák obtained his degree and doctorate in law from Janus Pannonious University. He was previously a Prosecutor and a Judge of the Supreme Court of Hungary before being appointed President in 2012. He is a member of the International Association of Tax Judges and a senior lecturer at the Financial Law Department of Eötvös Loránd University, Faculty of Law.

Justice Jennifer Davies was appointed to the Federal Court of Australia in 2013 and was previously a Judge of the Supreme Court of Victoria. She graduated in law from Monash University and was a Senior Counsel, and is a Senior Fellow at the University of Melbourne where she teaches in postgraduate courses. Justice Davies is a member of the International Association of Tax Judges.

Mr Jeremy Geale, CTA, is Deputy Chief Tax Counsel of the Australian Taxation Office. Jeremy joined the ATO in January 2016. He previously led KPMG’s Tax Controversy Practice as a partner of KPMG and was a member of KPMG’s Global Steering Committee for Tax Controversy. Jeremy worked as a barrister, as a lawyer at Minter Ellison and was the GST Manager at Qantas.

Mr Andrew Broadfoot QC is an Australian barrister practising in taxation and revenue law, and commercial law. He has appeared in and advised upon many disputes concerning international transactions, the interpretation of legislation imposing international obligations, and the construction of international agreements, including proceedings at first instance, in intermediate appellate courts, the High Court and international arbitrations.

Professor Miranda Stewart will Chair the event. She is a Professor at Melbourne Law School in the Tax Group and a Fellow at the Tax and Transfer Policy Institute, Australian National University, where she was director from 2014 to 2017. Miranda is Australian representative on the Permanent Scientific Committee of IFA and deputy president of the Asia Pacific committee. She previously worked in the ATO and in private practice.
