Although drug abuse has a long history, Vietnam has recently escalated its fight against drug-related crimes. This paper first discusses the elements of drug-related crimes under the Criminal Code of Vietnam 1999 (as amended in 2009) and calls for a series of reforms. It then analyses sentencing under the Vietnamese criminal law in general, with particular focus on drug-related crimes and the granting of clemency.
Dr Nguyễn Thị Phương Hoa is Vice Director of the Center for Legal Research on Human and Citizen’s Rights and Vice Dean of the Criminal Law Faculty, both at the Ho Chi Minh City University of Law, where she lectures on criminology, criminal law and international criminal law. Dr Nguyễn holds a PhD in law from the University of Wollongong and has researched crime and punishment in Vietnam, and, in particular, transnational crimes, the subject of her PhD thesis. She has a strong interest in international criminal law and her publications reflect this. Her latest publication is International Criminal Law and the Protection of Human Rights (Ho Chi Minh: National University Publishing House, 2014).
