Yan Wang

PhD Candidate


Yan Wang is a PhD candidate at the University of Melbourne. Yan holds a Juris Doctor (Queen’s University Belfast), an LLB-senior status (Queen Mary University of London), and a Bachelor of Science (Sun Yat-sen University). Yan’s research primarily focuses on remedies for intellectual property (IP) infringement as well as IP commercialisation & licensing. His PhD thesis focuses on the FRAND licensing of Standard Essential Patents. Yan joined Melbourne Law School in 2022. Prior to his candidature, Yan interned at Latham & Watkins’s Singapore office.

Reconceiving the FRAND licensing framework for Standard Essential Patents

Thesis Summary

The ETSI, a standards development organisation, in its IPR Policy requires the owners of Standard Essential Patents (SEPs) to grant licences on fair, reasonable and non-discriminatory terms (the FRAND commitment) to licensees who manufacture standards-compliant products. However, a notable gap in the ETSI IPR Policy is its lack of explicit clarification regarding the meaning of the FRAND commitment and its enforcement. This thesis develops a normative approach and conceives the FRAND licensing framework for SEPs based on this approach.
